1. Purpose
These Terms & Conditions govern the relationship between Medical Tourism Group Pty Ltd ("we", "us", or "our") and patients ("you" or "the patient") who make inquiries, consultations, or bookings through our administrative or marketing services for cosmetic procedures at the referred Hospitals (the "Hospital").
2. Nature of Services
a. We are a medical tourism as well as an independent administrative and marketing service provider working in cooperation with the Hospital. Our role is limited to:
- Providing information about the Hospital's available doctors, treatments, and services;
- Assisting with consultation scheduling, pricing information, and appointment management;
- Supporting patient communication and customer service; and
- Facilitating general inquiries and non-medical coordination.
b. In addition to administrative and marketing support, we may assist the patient with travel-related arrangements, including but not limited to:
- Flight bookings or recommendations;
- Hotel or accommodation reservations;
- Airport pickup, transportation, or logistics; and
- Scheduling and coordination with the hospital for consultation and procedure dates
c. We do not provide any medical consultation, medical advice, diagnosis, treatment, or perform any medical procedures.
3. Responsibility
a. All medical services, including consultations, diagnoses, treatments, procedures, surgeries, and post-operative care, are the sole responsibility of the Hospital and/or its licensed medical professionals. We are not a medical service provider and shall not be held liable for any:
- Medical advice, opinion, or recommendation given by doctors or medical staff;
- Results or outcomes of any medical procedure;
- Complications, side effects, or dissatisfaction arising from any treatment; or
- Miscommunications between the patient and the Hospital's medical staff.
b. All travel-related arrangements are solely made for the convenience of the patient, and we shall not be held responsible for:
- The availability, accuracy, or performance of any third-party service providers, such as airlines, hotels, drivers, etc.;
- Flight delays, cancellations, rescheduling or loss of luggage;
- Accommodation issues, booking errors or overbooking; and/or
- Transportation accidents or delays.
c. Any travel services arranged through us or recommended by us are subject to the separate terms and conditions of the respective providers. The patient is responsible for reviewing and agreeing to those terms directly with each third-party provider.
d. We may receive commissions, affiliate fees or incentives from certain travel or hospitality partners. Such financial arrangements do not affect our neutrality or the patient's freedom to choose any other travel or accommodation options.
4. Third-Party Service Providers
a. We may collaborate with independent contractors, agencies, and third-party partners to facilitate bookings, translation services, airport assistance, transportation, or concierge support. These third parties are not our employees or agents, and we are not liable for their acts, omissions, or negligence.
b. You agree that any issue, claim, or dispute arising from the actions of a third-party service provider must be resolved directly with that provider.
5. Medical Tourism Disclaimer
a. Traveling internationally for medical procedures involves inherent risks, including but not limited to:
- Differences in medical standards, post-operative care, and follow-up availability;
- Travel-related health risks (infection, fatigue, jet lag, or complications during flight);
- Visa issues, travel restrictions, or changes in entry requirements;
- Communication barriers or misunderstanding of medical advice.
b. You acknowledge and accept these risks. We shall not be liable for any adverse events, losses, or damages that may arise in connection with your travel or your decision to undergo a medical procedure abroad.
c. It is your responsibility to:
- Verify all medical documentation and travel requirements;
- Obtain any necessary travel or health insurance covering international medical procedures; and
- Ensure that your travel schedule allows sufficient time for rest and recovery before returning home.
6. Information Disclaimer
All information provided by us, whether through marketing materials, social media, messages, or verbal communication, is for general informational and promotional purposes only and should not be considered as medical advice.
Patients should always consult directly with a licensed medical professional before making any decision regarding medical treatments or procedures. You should not rely on the information provided by us as substitute for professional medical advice, diagnosis or treatment.
7. Insurance and Financial Responsibility
a. We strongly recommend that you obtain comprehensive travel insurance and medical complication insurance.
b. You acknowledge that we are not responsible for any costs or losses arising from your failure to obtain appropriate coverage.
8. Limitation of Liability
To the fullest extent permitted by applicable law, we shall not be liable for any loss, damage, injury, or expense of any kind (including, but not limited to, direct, indirect, incidental, special, or consequential damages) arising out of or in connection with:
- The performance or non-performance of medical procedures;
- Miscommunications or misunderstandings between you and the hospital;
- Any representations or warranties regarding results or safety of procedures;
- Any promotional statements, images or descriptions that differ from the actual outcome;
- Errors or inaccuracies in information provided by the hospital;
- Any dissatisfactions, complications, side effects or medical negligence.
9. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Natural disasters, epidemics, or pandemics;
- Travel restrictions, border closures, or visa issues;
- Political unrest, war or civil disturbances;
- Airline or transportation disruptions;
- Hospital closures or staff unavailability.
In such cases, we will make reasonable efforts to assist with rescheduling or alternative arrangements but not refunds or compensation shall be provided for events beyond our control.
10. International Data Transfer and Privacy
a. By engaging our services, you consent to the collection, use, and transfer of your personal data across borders as necessary for facilitating bookings and coordination with hospitals, travel partners, and related service providers.
b. We shall handle such data in accordance with applicable data protection laws in Indonesia, and ensure that appropriate safeguards are in place when sharing data with third parties or foreign entities.
c. You understand that some countries may have different privacy and data protection standards, and you consent to such transfers as part of the medical tourism process.
11. Refunds, Cancellations and Rescheduling
a. Any payments made for administrative, booking, or coordination services are generally non-refundable, except where required by law or specifically stated in writing.
b. Medical or travel-related refunds are subject to the cancellation policies of the respective providers (hospital, airline, or hotel). We do not control or guarantee any refund outcomes.
c. Requests for rescheduling will be accommodated on a best-effort basis and subject to the availability of both the Hospital and any third-party providers.
12. Patient Responsibilities
By proceeding with any appointment, consultation or procedure through us, you agree to:
a. Provide accurate and complete information during your consultation, booking, or communication;
b. Follow all medical advice and instructions provided by your licensed healthcare provider;
c. Clarify all treatment-related questions directly with the Hospital or medical professional before undergoing any procedure;
d. Not rely on any promotional material or marketing content as a guarantee of results or outcomes.
13. Patient Acknowledgment and Consent
By proceeding with any appointment, consultation or procedure through us, you confirm and acknowledge that:
a. You understand that we are not a medical provider and have no authority or involvement in the medical aspects of your care.
b. You understand that all medical procedures, advice, and treatment decisions are the sole responsibility of the Hospital and its licensed medical professionals.
c. You release and discharge us from any liability or claim arising from medical acts or omissions by the Hospital or its personnel.
d. You have had the opportunity to ask questions and have received satisfactory explanations regarding our limited role and responsibilities.
e. You voluntarily agree to these Terms without coercion or undue influence.
14. Governing Law and Jurisdiction
These terms are governed by and construed in accordance with the laws of the relevant jurisdiction. Any dispute arising out of or in connection with these Terms shall be submitted to the relevant jurisdiction.
15. Severability
If any provision of these Terms is found invalid or unenforceable by a court, such provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms & Conditions constitute the entire understanding between the patient and Medical Tourism Group Pty Ltd regarding the services provided. No verbal or written representations outside these Terms shall be binding unless expressly agreed in writing by both parties.
